Was your Arthritis, Degenerative Disc Disease, or Prior Injury Aggravated by a Work Injury?
An existing injury or medical condition is not in itself compensable under workers' compensation laws. However, if a work-related accident or injury aggravates or accelerates the existing condition, you may be eligible for workers' compensation disability benefits for aggravation of the pre-existing condition. For example:
- Degenerative disc disease that worsened or accelerated as a result of a work-related back or neck injury. Frequently, injuries involving a lumbar sprain, herniated disc, ruptured disc or slipped disc can seriously advance or worsen the conditions of degenerative disc disease.
- Arthritis that was aggravated by a repetitive stress injury such as carpal tunnel. Fibromyalgia, lupus, Rheumatoid Arthritis and other forms of arthritis can be aggravated by a work-related repetitive strain injury.
